Will of Lemuel Cocke

In the name of God, Amen. I Lemuel Cocke of Surry County and Parish of Southwark. Being of sound mind, and memory, do make and declare this my last will and testament here by revoking all former wills and testaments by me here-to-fore made.

I bequeath my soul to God and my body to the earth to be decently buried at the discretion of my Executors hereafter named, and as for what temporal estate it hath pleased almighty God to bestow upon me, I give and desposeth of it as followeth.

1.. I give and bequeath to my son, Henry Cocke, the lands in Brunswick County which I bought of Henry Hunt and William Limpy, to him and his heirs forever, also five Negroes, Dick, Amake, Cube, Mal, and Will to him and his heirs forever one silver tankard, one feather bed, furniture, six pewter plates and two dippers, five cows and calves, two chairs.

2.. I give and bequeath to my son, Rich Cocke, all my lands upon the three creeks joining to the aforesaid land which I gave to my son, Henry Cocke to him and his heirs forever also five Negroes, Charles, Juda, Jack , Arthur and Bett to him and his heirs forever. One feather bed of furniture, six pewter plates, two dippers, five cows and calves, six chairs, and a silver handled sword.

3.. I give and bequeath to my son, Lemuel Cocke, the tract of land given me by my father which I now leave to him and his heirs forever, also five Negroes, young George, Abram, Manuel, Tom, and Hannah after the death of his mother, to him and his heirs forever, one large gilt looking glass, one bed and furniture, six pewter plates, and two dippers five cows and calves, five chairs.

4.. I give and bequeath to my son Thomas Cocke, the tract of land which I purchased of my brother, Thomas Cocke, joining to the land I now live upon to him and his heirs forever also five Negroes Ben, Amy Quomona, Rofe, and Magee to him and his heirs forever, one black walnut desk, one bed and furniture, six pewter plates, and two dippers, five cows and calves, and six chairs.

5.. I give and bequeath to my daughter, Betty Cocke, five Negroes Sara, Douglas, and after my wife’s decease, Jimmy, and Sylvia his wife to her and her heirs forever. One feather bed, and furniture, one looking glass with a drawer, one Black walnut Coltfoot table, six pewter plates, and two dippers, six chairs, six china cups and saucers, and one slop bowl.

6.. I give and bequeath to my daughter, Anne Cocke, five Negroes Peter, Pratt, young Lydia, Joe, and Tom to her and her heirs forever. One feather bed and furniture, one black walnut table, six pewter plates, two dippers, one large china bowl, six chairs, one looking glass, with a drawer.

7.. I give and bequeath to my daughter, Sally Cocke, five Negroes, Lucy, Coffe, Nan, young Jemme, and Ephram to her and her heirs forever, one feather bed and furniture, one oval table, six pewter plates, two dippers, one china bowl, six chairs, one looking glass, with a large top.

8.. I give and bequeath to my beloved wife, Jane Cocke, the labour of six negroes during her natural life, old Frank, Phillis, Jimmy, Hannah, young Frank, and Lydia, Jimmy’s wife, also the use of the plantation I now live on which I have given to my son, Lemuel Cocke, during her natural life. I likewise give to my loving wife the furniture belonging to my dwelling house and kitchen which I have not given away to my children.

Likewise, my will and desire is that after my just debts and funeral charges are paid and discharged, all the remainder of my personal estate I give to my loving wife, and if any of my children should die before they come to the age of twenty-one years or marry, that their estates should be sold, and the money equally divided among the survivors of them. My will and desire is that John Justpers (?) should have the three tracts of ten acres of land for which he and I posted bonds provided he pay the money according to the bonds.

Lastly, I nominate and appoint my loving wife, my son, Henry and my brother, John Cocke, Executrix and executors of this my last will and testament which whereof I have here unto set my hand and affixed my seal this 13 day of April Anno Domini 1756.

At a court held for Surry County August the 17, 1756 the within written last will and testament of Lemuel Cocke (deceased) was presented in court by the executor therein named who made oath according to law of the same was proved by the oaths of Caleb Ellis, Rich Jones, and John Barker, the witnesses. Therefor is ordered to be recorded and on the motion of the said executors, certificate is granted her for obtaining a probate thereof in due form she having given bond as the law directs and liberty is reserved to Henry and John Cocke the other executors named in this will to join in the probate thereof when they shall think fit.

If Jane was born in 1717 and her father married Elizabeth (Rogers) Bolling in 1727, then Jane (and possibly others) had a different mother.
